How a divorce lawyer in Turkey can assist you
Before a petition is prepared or a settlement is signed, clarify your current position. Are both spouses seeking divorce? Is there agreement about the consequences? Has a case already been filed? Are there children, assets or proceedings in more than one country?
Hukuk&Co can arrange an initial consultation with the lawyer assessing your matter. Depending on the agreed scope, assistance may include reviewing your documents, assessing the relevant route, preparing or responding to a petition, reviewing proposed terms and representing you in agreed proceedings.
Planning a divorce
Understand the questions to resolve before filing, the available records and whether proposed terms need review.
Responding to proceedings
Review the petition, notification, hearing information and any existing orders before deciding how to respond.
Reviewing an agreement
Identify what a proposed protocol addresses, what it leaves unresolved and which obligations you would accept.
The consultation, settlement drafting, court representation and related property or cross-border work are not automatically a single service. Confirm the appointed lawyer, deliverables and fees before the agreed work begins.
Contested and uncontested divorce: what changes?
The terms çekişmeli boşanma and anlaşmalı boşanma describe different approaches. The choice is a legal assessment, not simply a preference for a faster case.
| Question | Agreement-based / uncontested | Contested |
|---|---|---|
| What needs review? | Eligibility for the route and the proposed terms. | Disputed events, legal claims and supporting evidence. |
| What should you prepare? | Marriage details, proposed protocol and unresolved questions. | A chronology, relevant records, petitions and notifications. |
| What is the lawyer’s focus? | The meaning and completeness of the arrangement. | The claims, defence, evidence and procedural options. |
| What should not be assumed? | That agreement alone guarantees a court decision. | That one disputed issue determines every other claim. |
| Can timing be guaranteed? | No universal completion date should be promised. | No universal completion date should be promised. |
Article 166(3) of the Turkish Civil Code addresses marriages lasting at least one year, a joint application or acceptance of the other spouse’s claim, the judge hearing the spouses personally and court approval of arrangements concerning financial consequences and children. The court may require changes accepted by the parties. Official Civil Code ↗
The one-year condition concerns this route; it should not be read as a general statement that no divorce case can be assessed for a shorter marriage.
For a divorce decision already issued abroad, check the intended effect in Turkey. Administrative registration under Article 27/A of Law No. 5490 may be available for qualifying civil-status decisions. Enforcing a separate order for maintenance, property or another obligation may require a different procedure. Civil registration authority guidance ↗
Uncontested divorce: review the protocol before relying on it
A proposed divorce protocol should be read as a set of commitments, not just a document confirming that the spouses want to separate. Ambiguous payment terms, incomplete property descriptions or unclear child arrangements can leave important questions unanswered.
The review can identify which issues are expressly covered, which are disputed and whether additional legal work is needed. Explain if a draft was prepared by your spouse, another adviser or a template source, and whether either party has already signed it.
- Financial terms: identify each proposed payment, its purpose, timing and any conditions.
- Children: describe the proposed arrangements and practical concerns that need assessment.
- Property and liabilities: identify the assets or debts mentioned, and matters excluded from the draft.
- Existing proceedings: provide any earlier petitions, orders or related cases.
- Language and understanding: raise translation or interpretation needs before signing.
The lawyer should explain the limits of the review and any work needed outside the divorce engagement. A translated or notarised text should not be treated as proof that the proposed settlement is appropriate for your circumstances.
Contested divorce: organise the facts and define the disputed issues
Where agreement is not possible, the initial assessment should distinguish the events relied on, the response to those events and the remedies each party seeks. A large collection of screenshots is less useful than a clear timeline supported by complete, relevant records.
Explain what happened, when it happened and which documents or witnesses may be relevant. The lawyer can assess the significance and lawful use of the available material and identify issues requiring further investigation. Do not access someone else’s accounts or obtain evidence through methods you have not discussed with a lawyer.
If proceedings already exist, provide the complete petition and any attachments, the notification record and subsequent orders. A summary of what the other party allegedly requested may omit important details. The case file and actual documents are the starting point for deciding how to respond.
Mention it in your first enquiry. An appointment request does not protect a deadline, file a response or confirm that a lawyer will attend a hearing. The required action and engagement must be confirmed separately.
Children, financial support and property need separate attention
A divorce consultation should identify related issues early, without assuming they are identical or automatically included in the same work.
Children and day-to-day arrangements
Explain the child’s current living and care arrangements, school location, existing orders and any proposed change. Raise concerns about contact, travel or relocation explicitly. The lawyer needs the actual circumstances rather than assumptions based on either parent’s nationality or preferred outcome.
For a more focused enquiry, see child custody, maintenance and alimony.
Maintenance, alimony and compensation requests
Financial questions should be supported by the available income, expense and liability information. Separate an agreed proposal from a disputed request and explain whether payments have already been made or ordered. The lawyer can assess which issues belong within the proposed engagement.
No fixed amount or entitlement should be promised from a short online outline.
Matrimonial property and business interests
Prepare a list of relevant property, accounts, business interests and debts, with acquisition dates and available funding records. Do not assume that an asset is resolved merely because it appears in a divorce discussion or that every asset is treated in the same way.
Asset investigation and property-division work may need a separate scope. See matrimonial property division.
The Civil Code also addresses temporary measures during divorce proceedings, including matters relating to accommodation, subsistence, property management and children. Ask the lawyer whether an immediate request needs assessment in your case. Article 169 ↗
Where there are safety concerns, explain them promptly. If there is immediate danger, use local emergency services rather than wait for a website response. Protective-measure assistance is a distinct matter to assess.
Divorce advice for foreign nationals and spouses living abroad
An initial consultation with a divorce lawyer in Istanbul can be online. Communication can be arranged in Turkish, English or Arabic, with the meeting language and any separate interpretation needs confirmed in advance.
If either spouse is abroad, identify their nationality, current location, marriage-registration details and any existing proceedings in another country. The lawyer should assess jurisdiction, the applicable issues, notification arrangements, the required authority and any personal-attendance requirements before advising on next steps.
Do not assume that signing a power of attorney makes every step remote. Equally, a foreign connection should not be treated as proof that a Turkish court is, or is not, the appropriate forum without reviewing the facts.
If you already have a divorce decision from another country, the question may concern its use or recognition in Türkiye rather than a new divorce. See recognition of foreign divorce judgments. Foreign-law advice and overseas representation require appropriately qualified counsel under confirmed arrangements.
Documents to prepare for the first divorce consultation
This is an initial-review guide, not an exhaustive court-filing checklist. Agree what will be reviewed and how confidential records should be shared.
| Record | Purpose of the initial review |
|---|---|
| Marriage and identity records | Establish the background and identify information needing confirmation. |
| A short relationship and proceedings timeline | Separate relevant events and identify the current stage. |
| Petitions, notices, orders and hearing details | Understand what has actually been requested or decided. |
| Proposed or signed divorce protocol | Review the commitments and unresolved questions. |
| Relevant child-related records | Explain present arrangements and any existing decisions. |
| Available financial and asset information | Identify the financial questions requiring separate assessment. |
| Relevant correspondence and lawfully held evidence | Assess relevance, completeness and limits of the material. |
| Foreign decisions or related proceedings | Identify cross-border questions and possible coordination needs. |
Keep originals secure and provide complete versions where available. Tell the lawyer if documents are missing, in another language or inconsistent. Translation, certification or document retrieval should be scoped separately where needed.
How the consultation and engagement work
- Send a brief outline.
State whether you are planning a divorce, responding to a case or reviewing an agreement. Mention children, overseas connections and any urgent date.
- Confirm the consultation scope.
Availability and potential conflicts are checked. Confirm the appointed lawyer, meeting format, questions, document set and consultation fee.
- Review the situation.
The lawyer assesses the agreed information, identifies gaps and explains which route or further investigation needs consideration.
- Agree further work.
Settlement drafting, filing, representation, financial claims and cross-border steps are agreed as applicable. Confirm deliverables, authority and external costs before proceeding.
Fees and timing: ask for a defined proposal
A useful fee proposal explains the work included, not just a headline price. Ask whether it covers the initial document review, drafting, negotiations, hearings and any later procedural steps. Property claims, foreign recognition, enforcement or written opinions may require separate work.
Professional fees should be distinguished from court charges, translation, certification and other external costs. A payment discussion does not by itself confirm acceptance of the matter.
There is no responsible fixed timetable for every divorce. Disputed issues, available evidence, notifications, court arrangements and subsequent steps can affect duration. The lawyer can explain the practical factors in your matter without guaranteeing a completion date.
Divorce lawyer questions
What is the difference between contested and uncontested divorce?
An agreement-based route relies on the relevant legal conditions and acceptable arrangements between the spouses. A contested case requires assessment of the disputed facts, claims and evidence. Read the comparison above, then have the lawyer assess the route for your circumstances.
We both want a divorce. Is a signed agreement enough?
Do not rely on the agreement alone. The agreement-based conditions and the court’s role described above still matter. A protocol should be reviewed before signing or relying on it as a complete resolution.
Can I begin the process while living outside Türkiye?
An initial consultation and agreed document review can be online. The lawyer must assess jurisdiction, service, representation and any personal-attendance requirements before advising on the court process.
Can my lawyer attend every step instead of me?
Do not assume that representation removes all personal participation. Explain the proposed route and your location so the lawyer can assess attendance and authority requirements, especially for an agreement-based case.
What happens if my spouse lives abroad or does not respond?
Provide their known location and any existing communication or proceedings. Notification arrangements, jurisdiction and the appropriate procedural response need assessment. Silence should not be treated as consent.
Are custody, maintenance and property all included in one engagement?
Not automatically. Confirm which requests and proceedings the lawyer will handle. Asset investigation, matrimonial property work, foreign recognition and enforcement may require separate scopes.
Can I use messages, photos or recordings as evidence?
Preserve existing material lawfully and explain how it was obtained. The lawyer should assess relevance and lawful use. Do not access another person’s accounts or create new recordings based on a general website statement.
How long will a divorce take in Turkey?
There is no reliable fixed timetable for every matter. The route, disputed issues, evidence, notifications, court arrangements and later procedural steps can affect timing. Ask for a case-specific explanation rather than a guaranteed completion date.
How much does a divorce lawyer cost?
Fees depend on the agreed work and its scope. Ask whether the proposal includes settlement drafting, hearings, financial claims, written advice and later steps. Court charges, translation, certification and other external costs should be identified separately.
I already have a decision or an upcoming hearing. What should I send?
Mention the date immediately and ask how to share the complete decision, notification record or hearing notice securely. Include existing petitions and orders where available. An enquiry does not protect a procedural deadline.

Divorce in Türkiye for foreign nationals and families abroad
If you need a divorce lawyer in Istanbul while living abroad, identify each spouse’s nationality and residence, any existing proceedings and the countries in which a decision may need to be used. A foreign nationality or overseas marriage does not, by itself, answer questions about jurisdiction, applicable law or recognition. These issues require an individual assessment alongside any property or child-related concerns.
