SECTOR PERSPECTIVES · TÜRKİYE

Healthcare, Hospitals & Clinics
Legal Services in Turkey

Legal support for healthcare organisations, clinical businesses, professionals and investors in Türkiye.

Healthcare legal work should reflect the type of institution, services and professional responsibilities involved. A hospital, dental clinic, medical centre and individual practitioner do not share one universal operating model. We connect business setup and investment with the contracts, records, governance and disputes arising in actual operations.

Sector context. A defined legal scope. Legal advice and representation are provided by the appointed lawyer. The responsible provider, relevant capability, work and fees are confirmed before an engagement begins.

SECTOR UNDERSTANDING

Why healthcare operations need coordinated legal support

Premises, professionals, patient relationships and commercial arrangements affect one another. An institution needs more than an incorporation document or isolated contract. We frame the legal work around the actual care model and responsible providers, helping owners identify legal decisions while clinical and technical functions remain with the appropriate specialists.

01 · WHO WE ADVISE

Businesses, investors and relevant individuals

Hospital and clinic operators, dental clinics, medical centres, practitioners, healthcare service businesses, owners and investors. Patients, employees, partners and suppliers may seek a separate assessment of a defined issue, subject to conflicts and the expertise required for the particular instruction.

Tell us whether you are planning a new project, reviewing a transaction, managing an existing relationship or responding to a dispute. Where parties have competing interests, the lawyer must check conflicts before advice is accepted. The engagement identifies the client, responsible lawyer and work to be undertaken, with separate scopes for different parties or projects where appropriate.

BUSINESS LIFE CYCLE

From market entry to operations, investment and exit

Establish or acquire the institution

Identify the institution type, intended services, ownership, premises and professional arrangements. Review the business documents and available permission records before commitment. Corporate, regulatory, financial, clinical and technical investigations should be scoped separately and coordinated where necessary.

Support ongoing operations

Review commercial agreements, corporate decisions, legal notices, patient-document questions, privacy and employment-related issues within the agreed scope. Maintain a defined process for instructions and escalation so a complaint or official communication is assessed by the responsible professional.

Invest, restructure or exit

Assess transaction terms, authority, liabilities, material agreements and identified regulatory risks. The documents should explain control, reporting, funding and exit arrangements. A legal review does not replace valuation, clinical-quality review or technical condition assessment.

Individuals, owners and partners with a specific problem

A patient, practitioner, employee, shareholder or supplier may need advice distinct from the institution. Identify who is the client and whose position is being assessed. Conflicts, specialist evidence and the appropriate procedure must be considered before work is accepted.

Tell us who the client would be and whose interests the advice should protect. A company, its shareholders and its customers can have different legal positions; a common business connection does not remove a conflict of interest.

EXAMPLE INSTRUCTION · NOT A CLIENT CASE

An investor considering a dental-clinic acquisition can request a defined review of corporate records, premises, operating agreements and identified regulatory issues, while clinical, technical and financial investigations are allocated separately. This is an illustrative instruction, not a completed mandate.

03 · HOW WE ASSIST

Connect the sector issue to the right legal service

Use the service pages below to explore the proposed work, documents and next steps. Your engagement should identify which parts of the project are included, which require additional expertise and which remain your business decisions.

Agree the boundaries. An initial consultation does not automatically include document drafting, negotiations, filings or proceedings. Technical, accounting, valuation, specialist regulatory and foreign-law work must be identified and expressly agreed where relevant.

ONGOING EXTERNAL LEGAL COUNSEL

A retained legal contact for your healthcare, hospitals & clinics business

Businesses can seek a recurring engagement for the legal work they need regularly, alongside separate instructions for major projects. The starting point is your operating model, recurring contracts, decision-makers and current legal concerns. The appointed lawyer confirms the scope, reporting arrangements and professional responsibilities before the engagement begins.

Commercial and operational follow-up

  • Review agreed categories of customer, supplier and business contracts.
  • Support negotiations, proposed amendments and formal correspondence within scope.
  • Assess recurring legal questions and identify matters needing a separate project.

Governance and legal escalation

  • Review authority, corporate decisions and relevant internal legal documents.
  • Maintain an agreed list of legal actions, documents and outstanding questions.
  • Assess notices, complaints and dispute options with appropriate urgency.

Make the working arrangement practical

Identify who can instruct the lawyer, who approves business decisions and how documents will be shared. Agree the covered legal areas, expected document volume, meeting arrangements, reporting and fee basis. A retainer should explain how new tasks are accepted and how additional work is authorised; it does not mean unlimited availability or an automatic response-time promise.

Litigation, arbitration, appeals, acquisitions, specialist regulatory applications and foreign-law work are included only where expressly agreed. Official charges, experts, translation, accounting and other external costs are separately identified. Technical and operational implementation remain with the responsible business team or appropriate specialist.

04 · RELEVANT EXPERIENCE

Experience, confidentiality and service scope

The service descriptions and example instruction explain the proposed legal scope. They are not accounts of completed client engagements, and no anonymised completed-matter case study is presented here.

When discussing a proposed engagement, ask which lawyer would be responsible, whether the relevant capability is available and what additional professional input is required. Any experience information shared must be accurate and respect confidentiality; it should not imply a promised result for another matter.

Private editorial review: completed-matter examples require documentary verification, a confidentiality review and permission where necessary before publication. No client names, results, transaction values or sector credentials have been invented.

05 · CROSS-BORDER CONSIDERATIONS

Foreign businesses entering or operating in Türkiye

Foreign investors and international healthcare businesses should explain the intended service, ownership, practitioners and patient group. Overseas professional credentials, approvals or corporate structures should not be assumed to resolve Turkish requirements. The legal review needs the actual documents and proposed activity.

Cross-border patient services, marketing, work permissions, data arrangements and foreign-law questions may require additional assessment. Identify who provides clinical care, who contracts with the patient and who handles any intermediary service. No institution approval, practitioner eligibility, clinical outcome or document acceptance is guaranteed.

Identify the parties

Confirm the legal entities, roles, countries and authority of the people giving instructions or signing documents.

Connect the documents

Review complete versions, schedules and related agreements. Flag inconsistent translations and missing records.

Allocate responsibilities

Agree the Turkish-law scope and who handles foreign advice, official processes and any specialist work.

Questions about healthcare, hospitals & clinics legal assistance

Can you support a clinic from establishment through operation?

A staged legal engagement can be considered for corporate setup, identified regulatory questions, contracts, governance and recurring advice. Clinical, technical and specialist regulatory responsibilities must be expressly allocated.

Can a patient request advice about a healthcare dispute?

A defined issue can be assessed subject to conflicts, expertise and agreed scope. Start with a short outline and ask for an agreed sharing method before sending sensitive medical or identity records.

Can you review patient and employment documents?

The relevant documents can form part of an agreed legal review. The scope should identify professional, employment and privacy expertise and distinguish legal drafting from clinical assessment or technical security assurance.

Does buying a clinic automatically resolve operating permissions?

Do not assume so. The transaction, institution, activity and current records require a specific assessment before relying on a proposed acquisition or operational change.

06 · DISCUSS YOUR LEGAL REQUIREMENTS

Discuss a project, dispute or retained-counsel scope for your healthcare, hospitals & clinics matter.

Describe your business or personal role, the project or issue, the countries involved and any approaching deadline. Identify the available documents and your preferred language. An initial meeting can be arranged online or by appointment in Istanbul, subject to availability and conflicts.

Ask for an agreed sharing method before sending confidential commercial records or personal information. The appointed lawyer, scope, consultation fee and any separate work are confirmed before the agreed service begins.
